هذه السياسة صادرة عن شركة انفلونسر للدعاية والتسويق (شركة الشخص الواحد)، المسجلة في دولة الكويت بالسجل التجاري رقم 484771، ترخيص رقم 2023/21481، وعنوانها المسجل: محافظة العاصمة، الخالدية، قطعة 001، شارع 19، قسيمة 000160، دولة الكويت (ويشار إليها فيما يلي بـ "الشركة" أو "نحن"). "تاجر" (Tajer) علامة تجارية وخدمات تقنية مملوكة ومشغّلة من قبل الشركة.
This policy is issued by Influencer Advertising and Marketing Company S.P.C., registered in the State of Kuwait under Commercial Registration No. 484771, License No. 2023/21481, with its registered address at Al-Khaldiya, Block 001, Street 19, Parcel 000160, Capital Governorate, State of Kuwait (the "Company", "we", "us"). "Tajer" is a brand and technology service owned and operated by the Company.
2. نطاق هذه السياسةScope of This Policy
تنطبق هذه السياسة على: (أ) موقعنا الإلكتروني influencer-advertising.com وأي مواقع أو صفحات تشغّلها الشركة؛ (ب) خدمات الدعاية والتسويق التي نقدمها لعملائنا؛ (ج) منصة تاجر لأتمتة خدمة العملاء عبر واتساب المقدمة للشركات المشتركة. إذا تعارضت هذه السياسة مع اتفاقية مكتوبة موقعة مع عميل تجاري، تسود الاتفاقية المكتوبة بالقدر المسموح به قانونًا.
This policy applies to: (a) our website influencer-advertising.com and any websites or pages operated by the Company; (b) the advertising and marketing services we provide to our clients; and (c) the Tajer WhatsApp customer-service automation platform provided to subscribed businesses. Where this policy conflicts with a signed written agreement with a business client, the written agreement prevails to the extent permitted by law.
3. المعلومات التي نجمعهاInformation We Collect
معلومات تقدمها لنا مباشرة: مثل الاسم وبيانات التواصل ومحتوى الرسائل عند استخدام نماذج التواصل في الموقع أو عند طلب خدماتنا. معلومات حسابات العملاء التجاريين: مثل اسم النشاط، بيانات التسجيل التجاري، بيانات المستخدمين المفوضين، وبيانات الفوترة والدفع. بيانات الاستخدام التقنية: مثل سجلات الدخول، نوع المتصفح، وعنوان IP، وملفات تعريف الارتباط (كوكيز) وأدوات التحليل.
Information you provide directly: such as your name, contact details, and message content when using website contact forms or requesting our services. Business client account information: such as business name, commercial registration details, authorized user details, and billing and payment information. Technical usage data: such as access logs, browser type, IP address, cookies, and analytics data.
بيانات منصة تاجر: عند اشتراك عميل تجاري في تاجر، تعالج المنصة محادثات واتساب الواردة إلى رقم العميل التجاري وما يرتبط بها من بيانات (مثل رقم هاتف المرسل، اسم العرض، محتوى الرسائل والوسائط، وحالة المحادثة)، وذلك لتشغيل الردود الآلية، وصندوق المحادثات، والتحويل البشري، والتقارير.
Tajer platform data: when a business client subscribes to Tajer, the platform processes WhatsApp conversations received on the business client's number and related data (such as sender phone number, display name, message and media content, and conversation state) in order to operate automated replies, the conversation inbox, human handoff, and reporting.
4. كيف نستخدم المعلوماتHow We Use Information
نستخدم المعلومات من أجل: تقديم خدماتنا وتشغيلها وتحسينها؛ إنشاء حسابات العملاء التجاريين وإدارتها؛ تشغيل الردود الآلية ضمن قاعدة المعرفة المعتمدة لكل عميل تجاري؛ الفوترة وتتبع الاستخدام؛ الدعم الفني وخدمة العملاء؛ الأمان ومنع إساءة الاستخدام؛ والالتزام بالمتطلبات القانونية. لا نبيع البيانات الشخصية.
We use information to: provide, operate, and improve our services; create and manage business client accounts; operate automated replies within each business client's approved knowledge base; perform billing and usage tracking; provide technical support and customer service; maintain security and prevent abuse; and comply with legal requirements. We do not sell personal data.
5. أدوار معالجة البيانات في منصة تاجرData Processing Roles on the Tajer Platform
في خدمات تاجر، يكون العميل التجاري هو المسؤول عن بيانات عملائه النهائيين وعن مشروعية تواصله معهم عبر واتساب، بينما تعمل الشركة كمقدم خدمة يعالج هذه البيانات نيابة عن العميل التجاري ووفق تعليماته ولأغراض تشغيل الخدمة فقط. تُنظم تفاصيل هذه المعالجة في اتفاقية الخدمة وملحق معالجة البيانات مع كل عميل تجاري. الردود الآلية تُولَّد ضمن حدود قاعدة المعرفة المعتمدة من العميل التجاري، مع إمكانية التحويل إلى موظف بشري.
For Tajer services, the business client is responsible for its end customers' data and for the lawfulness of its communication with them on WhatsApp, while the Company acts as a service provider processing such data on behalf of the business client, under its instructions, and solely for the purpose of operating the service. The details of this processing are governed by the service agreement and data-processing addendum with each business client. Automated replies are generated within the limits of the business client's approved knowledge base, with the ability to escalate to a human agent.
6. مشاركة المعلومات والأطراف الثالثةSharing and Third Parties
قد نشارك المعلومات مع: (أ) Meta/WhatsApp بصفتها مشغّل منصة WhatsApp Business التي تمر الرسائل عبرها وفق شروطها وسياساتها؛ (ب) مزودي خدمات نعتمد عليهم في التشغيل مثل الاستضافة وقواعد البيانات ومزودي نماذج الذكاء الاصطناعي ومزودي بوابات الدفع المحلية؛ (ج) الجهات الرسمية عندما يتطلب القانون ذلك. نلزم مزودي الخدمات بحماية البيانات وقصر استخدامها على تقديم الخدمة.
We may share information with: (a) Meta/WhatsApp, as the operator of the WhatsApp Business Platform through which messages are transmitted, subject to its own terms and policies; (b) service providers we rely on to operate, such as hosting and database providers, AI model providers, and local payment gateway providers; and (c) public authorities where required by law. We require service providers to protect data and to use it only to deliver the service.
7. الاحتفاظ بالبياناتData Retention
نحتفظ بالبيانات للمدة اللازمة لتقديم الخدمة وللأغراض المبينة في هذه السياسة، ثم نحذفها أو نجعلها مجهولة الهوية ما لم يتطلب القانون الاحتفاظ بها لمدة أطول. بيانات محادثات منصة تاجر تُحتفظ وفق إعدادات وخطة العميل التجاري واتفاقية الخدمة، وتُحذف أو تُعاد للعميل التجاري عند انتهاء الاشتراك وفق تلك الاتفاقية.
We retain data for as long as necessary to provide the service and for the purposes described in this policy, after which it is deleted or anonymized unless a longer retention period is required by law. Tajer conversation data is retained according to the business client's settings, plan, and service agreement, and is deleted or returned to the business client upon subscription termination in accordance with that agreement.
8. أمن المعلوماتSecurity
نطبق تدابير تقنية وتنظيمية مناسبة لحماية البيانات، تشمل التشفير أثناء النقل، وضوابط الوصول، وعزل بيانات كل عميل تجاري عن غيره، وسجلات التدقيق للعمليات الحساسة. ومع ذلك، لا توجد وسيلة نقل أو تخزين آمنة بنسبة مئة بالمئة، ولا يمكننا ضمان الأمان المطلق.
We apply appropriate technical and organizational measures to protect data, including encryption in transit, access controls, isolation of each business client's data, and audit logs for sensitive operations. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. حقوقك وخياراتكYour Rights and Choices
يمكنك التواصل معنا لطلب الاطلاع على بياناتك الشخصية لدينا أو تصحيحها أو حذفها، وذلك عبر البريد الإلكتروني apps@influencer-advertising.com. إذا كانت بياناتك جزءًا من محادثات أحد عملائنا التجاريين عبر منصة تاجر، فقد نوجه طلبك إلى ذلك العميل التجاري بصفته المسؤول عن بيانات عملائه، أو نساعده في تنفيذه. سنرد على الطلبات خلال مدة معقولة ووفق القانون المعمول به.
You may contact us to request access to, correction of, or deletion of your personal data held by us at apps@influencer-advertising.com. If your data forms part of a business client's conversations on the Tajer platform, we may direct your request to that business client as the party responsible for its customers' data, or assist it in fulfilling the request. We will respond to requests within a reasonable period and in accordance with applicable law.
10. ملفات تعريف الارتباط والتحليلاتCookies and Analytics
يستخدم موقعنا ملفات تعريف الارتباط وأدوات تحليل لقياس الاستخدام وتحسين التجربة. يمكنك ضبط متصفحك لرفض ملفات تعريف الارتباط، مع العلم أن بعض خصائص الموقع قد لا تعمل بشكل كامل عندئذ.

11. نقل البيانات خارج دولة الكويتInternational Data Transfers
قد تتم معالجة البيانات أو تخزينها على خوادم تقع خارج دولة الكويت لدى مزودي خدمات سحابية معتمدين. عند نقل البيانات خارج الكويت، نتخذ خطوات معقولة لضمان بقائها محمية بمستوى مناسب وفق هذه السياسة والاتفاقيات المبرمة مع مزودي الخدمات.
Data may be processed or stored on servers located outside the State of Kuwait with established cloud service providers. Where data is transferred outside Kuwait, we take reasonable steps to ensure it remains protected to an appropriate standard under this policy and our agreements with service providers.
12. خصوصية القاصرينChildren's Privacy
خدماتنا موجهة للشركات والأنشطة التجارية وليست موجهة للقاصرين، ولا نجمع عن قصد بيانات شخصية من القاصرين. إذا تبين لنا جمع بيانات قاصر دون موافقة معتبرة قانونًا، سنحذفها.
Our services are directed at businesses and are not directed at minors, and we do not knowingly collect personal data from minors. If we become aware that we have collected a minor's data without legally valid consent, we will delete it.
13. التعديلات على هذه السياسةChanges to This Policy
قد نحدّث هذه السياسة من وقت لآخر. سننشر النسخة المحدثة على هذه الصفحة مع تاريخ آخر تحديث، وقد نخطر العملاء التجاريين بالتغييرات الجوهرية عبر البريد الإلكتروني أو من خلال المنصة.
We may update this policy from time to time. We will post the updated version on this page with its last-updated date, and we may notify business clients of material changes by email or through the platform.
14. القانون الواجب التطبيقGoverning Law
تخضع هذه السياسة لقوانين دولة الكويت وما ينطبق من لوائح وتنظيمات كويتية متعلقة بالخصوصية والأمن السيبراني والاتصالات.
This policy is governed by the laws of the State of Kuwait and applicable Kuwait privacy, cybersecurity, and communications regulations.
